The product incorporates the same active and inert components as a federally registered product,
but in several percentages. Different uses of the same product,
or makes use of of a product of comparable composition, have
had their registration denied, disapproved, suspended, or canceled by the Administrator.
The registration for the same use has not previously been denied,
disapproved, suspended, or canceled by EPA, or voluntarily canceled by the registrant subsequent to EPA's issuance
of a notice of intent to cancel because of health or environmental considerations about an ingredient contained in the product, until EPA
has reversed the original motion. The state company should consult with
EPA personnel earlier than issuing SLN for a pesticide use that was voluntarily canceled.
State regulation of pesticides began in 1975. EPA conducted a pilot program with six states taking over primary
enforcement accountability for FIFRA. States receive
their pesticide regulation authority by FIFRA and through state pesticide legal guidelines.
At this level the state is given 90 days to reply, after which EPA can rescind the
state's enforcement authority whether it is deemed obligatory.
